Warranty

Ember Malls (“we,” “us,” or “our”) provides a limited warranty for all our patented temperature controlled mugs, travel mugs, tumblers, and baby bottle systems (collectively, “Products”) purchased directly from embermalls.com. This limited warranty applies solely to the original purchaser (“you” or “your”) of the Products and is non-transferable. By purchasing and using our Products, you agree to the terms and conditions outlined in this Warranty Terms document.

1. Warranty Period

All Products are covered by a one (1) year limited warranty from the date of original purchase. This warranty period commences on the date your order is delivered to you, as confirmed by the shipping confirmation email and order records. The warranty period cannot be extended, modified, or renewed, except as explicitly stated in this document or required by applicable law.

2. Warranty Coverage

This limited warranty covers defects in materials and workmanship of the Products under normal use and proper care, in accordance with the usage instructions provided with each Product. Specifically, the warranty covers malfunctions or failures of the patented temperature control technology, structural defects, and issues with components that affect the Product’s intended functionality (e.g., temperature regulation, lid seal, or battery performance for rechargeable models).
During the warranty period, if a covered defect is identified, we will, at our sole discretion, either repair the defective Product or replace it with a Product of similar features and value, free of charge. This remedy constitutes our sole obligation and your exclusive remedy under this limited warranty[1].

3. Warranty Exclusions

This limited warranty does not cover any damage, malfunction, or failure caused by the following, and such issues will not be eligible for repair or replacement under this warranty:
  • Normal wear and tear from regular use, including but not limited to scratches, dents, fading, or cosmetic damage that does not affect the Product’s functionality.
  • Failure to follow the provided usage, care, or maintenance instructions (e.g., using the Product in a microwave, dishwasher, or with improper voltage/power supply).
  • Accidental damage, misuse, abuse, negligence, or intentional harm to the Product (e.g., dropping, crushing, or exposing the Product to extreme temperatures).
  • Consumable components (such as batteries for rechargeable models), which are subject to normal degradation over time and are not covered beyond the initial purchase.
  • Products that have been modified, altered, or repaired by anyone other than Ember Malls or our authorized repair services, including the use of unauthorized parts or attachments.
  • Products that are missing a valid serial number or identification mark, or have had their serial number tampered with.
  • Damage caused by circumstances beyond our control, including but not limited to natural disasters, power surges, or third-party mishandling during shipping (after delivery to you).
  • Loss or damage to removable parts (e.g., lids, straws) that are not integral to the Product’s core temperature control functionality.
Additionally, this warranty does not cover software embedded in any Product or related services (if applicable), including Bluetooth connectivity or app integration (if applicable)[8].

4. How to Make a Warranty Claim

To initiate a warranty claim, please follow these steps within the one-year warranty period:
  1. Contact our customer service team at press@embermalls.com, providing your original order number, the date of purchase, a detailed description of the defect or malfunction, and clear photos/videos of the issue (if applicable). This information helps us quickly review and process your claim.
  2. Our customer service team will review your claim within 1–2 business days. If your claim is approved, we will provide you with a pre-paid return shipping label (free of charge) and detailed instructions for returning the defective Product to our warehouse.
  3. Ship the defective Product back to us using the provided pre-paid label. Please ensure the Product is securely packaged to prevent further damage during transit. You are responsible for ensuring the Product is received by us; we recommend retaining proof of shipment.
  4. Once we receive and inspect the defective Product (typically 3–5 business days after delivery to our warehouse), we will either repair the Product or send you a replacement. The repair or replacement process will be completed within 7–10 business days of receiving the defective Product.
Please note that incomplete or inaccurate information may delay the processing of your warranty claim. We reserve the right to deny any claim that does not meet the eligibility criteria outlined in this warranty.

5. Additional Terms

  • Shipping for Warranty Claims: We cover all return shipping costs for eligible warranty claims. Replacement Products will be shipped to you free of charge, in accordance with our standard shipping policy (1–3 business days processing, 6–12 business days delivery).
  • Refunds Under Warranty: Refunds are only provided if repair is not commercially practicable or cannot be timely made, or if you elect to receive a refund instead of a repair or replacement (at our discretion)[9]. Refunds will be issued in USD (United States Dollars) to the original payment method used for the purchase, minus no additional fees.
  • Implied Warranties: To the extent required by applicable law, implied warranties of merchantability or fitness for a particular purpose are not excluded by this limited warranty. However, such implied warranties are limited to the duration of this one-year limited warranty[1].
  • Limitation of Liability: Ember Malls shall not be liable for any incidental, consequential, or indirect damages arising from the use or malfunction of the Products, including but not limited to loss of use, inconvenience, or damage to other property.   • State/Local Laws: This warranty is subject to applicable state and local laws, which may provide additional rights that are not waived by this document.
